Yesterday, MichCon notified its EUT brokers that, subject to certain conditions, it was waiving the 3% withdrawal restriction during the month of November 2009. As a follow up to that message, please be advised that this action is intended to relieve potential storage constraints in early November. To that end, MichCon is requesting all EUT brokers to continue cooperating with us by not ramping up supply deliveries during the remainder of October. We appreciate your ongoing assistance and cooperation as we continue our efforts to avoid future supply curtailments."

During the months of November through March, monthly withdrawals from storage for end-use transportation (EUT) customers are limited to 3% of their contract ACQ (see Section F, Sheet F-19.00 of MichCon's tariff). MichCon will waive the monthly withdrawal limit for all EUT customers during November 2009. EUT customers who exceed the 3% of ACQ monthly withdrawal limit during November 2009 will not be assessed an Unauthorized Gas Usage Charge, unless the EUT customer uses MichCon's system supply (i.e., monthly consumption exceeds the sum of gas in storage and net deliveries to MichCon). If this occurs, then Unauthorized Gas Usage Charges will be assessed. All other terms and conditions of MichCon's tariff and gas transportation agreements remain in effect. If you have questions, please contact MichCon's Gas Nominations staff or the customer's assigned Gas Account Manager. The 3% of ACQ monthly withdrawal limit will be reinstated commencing December 2009 unless notified otherwise.

On September 24, 2009, MichCon reminded its shippers of the potential for near term supply constraints depending on upcoming weather and market conditions. In that message, MichCon also advised shippers to rank both their supply and markets within eNominator. The purpose of this ranking is two-fold. First, it allows our shippers some degree of control over how cuts will be performed. Second, it provides MichCon's Gas Nominations staff the ability to administer cuts in the short time frame required by interconnecting interstate pipelines.
A few shippers have asked MichCon whether they could apply the same ranking to multiple sources of supply and/or markets. Unfortunately, such action will undermine MichCon's ability to administer the cuts in the time frame required by the interconnecting pipes. Thus, please be advised that when the same ranking is applied to multiple supply sources and/or markets, MichCon will apply cuts based on its best judgement, taking into account tight confirmation deadlines on interconnecting pipes.
Please note that shippers and brokers have the ability to change their supply and market rankings on a daily basis. Natural gas storage balances across the nation are perilously close to the record inventories experienced in 2007 with seven weeks still remaining in the traditional injection season. MichCon's storage balances and the associated impact on operations...
Natural gas storage balances across the nation are perilously close to the record inventories experienced in 2007 with seven weeks still remaining in the traditional injection season. MichCon's storage balances and the associated impact on operations reflect this nationwide trend. In order to maintain operational integrity, MichCon may be required to curtail the receipt of flowing supply into its system depending on upcoming weather conditions and market requirements. As a reminder, End User Transportation (EUT) customers' storage balances must not exceed 10% of their Annual Contract Quantity (ACQ), and September and October storage injections must not exceed 1.43% of ACQ. MichCon will continue to closely monitor EUT accounts to ensure compliance with this requirement. MichCon will continue to reduce to zero the Maximum Daily Quantities associated with EUT accounts that have exceeded their storage limitations.
MichCon Gathering shippers are also reminded that nominations and production must be closely aligned. Should supply cuts at Kalkaska be necessitated, production must be reduced accordingly.

The October 2009 MDQ reductions have been determined and eNominator has been updated accordingly. EUT MDQs are recalculated for the months of September and October based on 3-year actual historical consumption in those respective months plus a daily allotment for storage injections (1.43% x ACQ / # days in month). The recalculated MDQs for customers will not be posted. Please contact Jerry DeRuiter 313.235.1042 or Doug Lowney 313.235.1403 to obtain the recalculated MDQs.
MichCon will only allow MDQ increases if the customer provides their MichCon Account Manager with documented usage that is greater than the recalculated October MDQs. Please take note that per MichCon's tariff, any monthly injections greater than 1.43% of a customer's ACQ will be subject to an Excess Storage Charge of $0.246 per MMBtu plus 1.42% gas-in-kind retention (this will be in addition to any gas in a customer's storage account greater than 10% of ACQ).

If you do not serve End User Transportation (EUT) customers, please disregard this note.
Effective with the Gas Day of August 1, 2009, MichCon will reject nominations made on behalf of EUT customers whose storage balances are in excess of 10% of their Annual Contract Quantity (ACQ) as of June 30, 2009. MichCon will reject nominations until it has satisfied itself that the volume of gas retained for the customer is less than 10% of the customer's ACQ. MichCon is authorized to take such action under the "Transportation Service" provision of its Transportation Service Rate applicable to Rates ST, LT, and XLT (Section E, Sheet E-24.00). This provision states, in part, "Should the aggregate volume of gas, less the allowance for company-use and lost-and-unaccounted-for gas, retained by Company at Month-end exceed 10% of the Annual Contract Quantity, then Company shall have the rights: (1) to refuse to receive any additional volume of gas for that Customer until Company has satisfied itself that the volume of gas retained for Customer is less than 10% of the Annual Contract Quantity, and (2) to charge Customer for the storage of any Month-end balance that exceeds 10% of the Annual Contract Quantity."
The MDQ for an EUT customer in excess storage will remain set at zero until such time the EUT Customer or their agent provide proof (detailed balancing calculations including meter reads) to the MichCon Account Manager that the customer's account storage balance is in compliance.
MichCon encourages all marketers and brokers to review their EUT customers' month-end storage positions and reduce nominations accordingly for EUT customer accounts that are projected to be in an excess storage position. It is anticipated that MichCon will be enforcing this provision of the EUT tariff for the remainder of the injection season. If you have questions, please contact your customer's MichCon Account Manager or Kelly Naragon at 313-235-1036. April 2009 Dry actual volumes for Dry Receipt Point operators are now available in eNominator. Operators, please enter your Allocations by May 8, 2009 by noon EST in eNominator. The Petoskey Service is effect from April 1, 2009 - October 31, 2009 for Dry Points (Jordan 4, Chestonia, Mancelona). These 3 points will be allocated to the Petoskey Service contract first to match the nomination and allocate the remainder to the dry pooling contract. Reminder: Change the Allocated Methed to "Operator Provided Value" (OPV) or refer to the Dry Cashout section of your training manuals. MichCon has initiated its annual review of each End-Use Transportation (EUT) customer's Annual Contract Quantity (ACQ) and Maximum Daily Quantity (MDQ). During the week of April 27th, MichCon will send notification letters to all EUT customers...
If you do not serve End User Transportation (EUT) customers, please disregard this notice.
Dear EUT Brokers:
MichCon has initiated its annual review of each End-Use Transportation (EUT) customer's Annual Contract Quantity (ACQ) and Maximum Daily Quantity (MDQ). During the week of April 27th, MichCon will send notification letters to all EUT customers. The revised ACQ and MDQ contract values will be set forth in the letter, along with the methodology utilized in calculating each as defined in MichCon's Rate Book. The revised ACQs and MDQs will become effective on June 1, 2009. The new quantities will be loaded into eNominator and available on or about May 22, 2009.
The notification letter will advise customers to immediately communicate any changes to their brokers and/or energy managers. The letter will advise customers to contact their MichCon Account Managers by May 12, 2009 with any questions or concerns about the revised quantities.
We suggest that customers and their brokers/energy managers closely monitor storage balances in order to arrange for any storage transfers that may be necessitated as a result of the revised quantities. The $25 storage transfer fee will apply to these transactions.
Should you have any questions, please contact your customers' Account Managers. Thank you for your cooperation and assistance in managing the customers' accounts.

The dry cashout trading window will open at 9:30am EST on Tuesday, April 14th and Imbalances will be posted at that time. The trading window will remain open until 5pm EST, Wednesday, April 15th. If trading occurs, eNominator will e-mail you a trade confirmation. On Wednesday, April 15th, you will receive the "post trading statement" at approximately 5:30pm EST. Final dry cashout invoices will continue to mailed out Gas Accounting.
